Terms of Service
Please review these terms before using DoctorCareBox clinic, patient, inventory, billing, and appointment services.
1. Introduction and Acceptance
These Terms of Service ("Terms") govern access to and use of the DoctorCareBox website, mobile application, and related services (collectively, the "Platform"), owned and operated by DoctorCareBox, having its registered/operating address at M4 Shatabdi Nagar, Aligarh, Uttar Pradesh 202001, India ("DoctorCareBox", "we", "us", or "the Company").
These Terms apply to registered medical practitioners and clinics ("Doctors" or "Clinics"), their staff members granted access under a Clinic account ("Staff"), and any patients whose records are managed through the Platform ("Patients"). Doctors, Staff, and Patients are together referred to as "Users" or "you."
By creating an account, accessing the Platform, or using any DoctorCareBox service, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
We may revise these Terms from time to time. Continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
2. Description of Services
DoctorCareBox provides a clinic and patient management system that allows Doctors and their authorized Staff to:
We aim to keep the Platform available, accurate, and secure, but we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances outside our control. We are not liable for any loss arising from such interruptions.
We may add, modify, suspend, or discontinue any feature of the Platform at our discretion, with notice provided through the Platform or other reasonable means where practical.
- Register and manage patient records
- Create and issue digital prescriptions
- Maintain a medicine/product catalogue and manage inventory
- Generate purchase orders to replenish stock
- Sell medicines directly to patients and generate medicine bills/invoices
- Schedule, manage, and track patient appointments
- Send OTP (one-time password) messages for account verification and login
- Send appointment reminders and related transactional messages via SMS and/or email
3. Account Registration and Eligibility
To use the Platform, a Doctor must be a qualified medical practitioner or represent a duly licensed clinic, and where applicable, hold valid registration with the National Medical Commission or the relevant State Medical Council (or equivalent recognized authority). By registering, you confirm this is true and that nothing legally prevents you from practicing medicine or operating your clinic in India.
Each Clinic account has one Owner (the person who registers the clinic) and may add additional Staff members (including other doctors and receptionists) with role-based access. The Owner is responsible for the accuracy of information about Staff added to their Clinic account and for managing who has access to the account.
You are responsible for maintaining the confidentiality of your login credentials, including any OTP sent to your registered mobile number, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account. We are not liable for losses arising from your failure to keep your credentials secure.
Newly added Staff accounts are issued a default temporary password, which the Staff member is responsible for changing after first login.
We reserve the right to suspend or terminate any account that provides false information, violates these Terms, or is used in a manner that risks harm to Patients, other Users, or the Platform.
4. Patient Data and Confidentiality
4.1 Doctor and Staff Responsibilities
Doctors and Staff will have access to sensitive patient information, including medical history, prescriptions, contact details, and billing information ("Patient Data"). Doctors and Staff agree to:
Patient Data is entered by Doctors, Staff, or Patients themselves. DoctorCareBox provides this information on an "as-is" basis and does not independently verify its accuracy.
- Treat all Patient Data as confidential
- Access Patient Data only as necessary to provide care or manage the Clinic's operations
- Obtain any consent required from Patients before recording or sharing their information through the Platform
- Comply with applicable medical ethics guidelines and data protection law, including the Digital Personal Data Protection Act, 2023, where applicable
4.2 Restrictions on Use of the Platform
Users must not:
- Copy, resell, or republish any part of the Platform except as intended through normal use
- Share login access with unauthorized individuals
- Attempt to reverse-engineer, decompile, or extract the source code of the Platform
- Use automated tools (bots, scrapers) to access or extract data from the Platform
- Attempt to gain unauthorized access to accounts, servers, or data not belonging to them
- Probe, scan, or test the security of the Platform without authorization
- Interfere with or disrupt the Platform's infrastructure or availability
Violations of this section may result in immediate account termination and may expose the responsible party to liability for resulting losses.
4.3 Our Security Commitments
We apply reasonable technical and organizational safeguards to protect Patient Data, including:
We do not sell Patient Data to third parties. We may disclose information where required by law, to enforce these Terms, or to protect the rights, safety, or property of DoctorCareBox, our Users, or others.
- Password hashing (passwords are never stored in plain text)
- Encrypted (HTTPS) communication between your device and our servers
- Session-based authentication after login
- Role-based access control, so Staff only see what their assigned role permits
- Access restrictions on sensitive data based on Clinic and account ownership
5. De-Identified and Aggregated Data
We may use data that has been de-identified - meaning names, contact details, and other identifying information have been removed or altered so that no individual Patient can reasonably be identified - for purposes such as improving the Platform, analytics, research, and reporting. We will not use de-identified data in a way that re-identifies a specific Patient or that could be used to target or solicit a Doctor's specific patients.
6. Fees, Billing, and Sales Through the Platform
Subscription fees for Clinic accounts, if applicable, will be communicated at the time of sign-up or upgrade. We reserve the right to modify pricing with reasonable prior notice.
Where a Clinic uses the Platform to sell medicines directly to Patients, generate bills, or manage purchase orders, the Clinic (not DoctorCareBox) is solely responsible for:
DoctorCareBox provides the tools to record and manage these transactions but is not a party to the sale of medicines between a Clinic and a Patient.
- The accuracy of pricing, stock, and billing information entered
- Compliance with applicable drug licensing, pharmacy, and retail regulations
- Issuing valid invoices as required under applicable tax law
7. Communications and Messaging Consent
By registering on the Platform, you consent to receive OTP messages, appointment reminders, and other transactional communications via SMS, email, or other channels, sent to the mobile number or email address associated with your account - including if that number is registered under India's National Customer Preference Register (NCPR/DND) - solely for account verification, appointment management, and service-related purposes.
Each login, appointment booking, or similar action is treated as a fresh request for these transactional communications, consistent with the Telecom Commercial Communications Customer Preference Regulations, 2018.
Promotional or marketing communications, if any, will only be sent with separate consent, and you may opt out of these at any time without affecting transactional messages necessary for the Platform to function.
8. Termination
We may suspend or terminate a Clinic's or User's access to the Platform if these Terms are violated, or where required by law. Upon termination:
- Access to the Platform will end
- We will make reasonable efforts, where feasible, to allow the Clinic to export their patient and clinic data prior to permanent deletion, to support continued record-keeping obligations
- Provisions of these Terms that by their nature should continue to apply (such as confidentiality, indemnification, and limitation of liability) will survive termination
9. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure, or that any defect will be corrected. Use of the Platform is at your own risk.
The Platform is a practice-management and record-keeping tool. It does not provide medical advice, and DoctorCareBox is not responsible for clinical decisions, diagnoses, prescriptions, or treatment provided by Doctors using the Platform.
10. Indemnification
You agree to indemnify and hold harmless DoctorCareBox, its officers, employees, and affiliates from claims, losses, damages, and reasonable legal costs arising from your use or misuse of the Platform, or your violation of these Terms or any applicable law.
11. Limitation of Liability
To the maximum extent permitted by law, DoctorCareBox will not be liable for indirect, incidental, special, or consequential damages, including loss of data, revenue, or goodwill, arising from use of the Platform. Our total liability for any direct damages arising from use of the Platform will not exceed the subscription fees paid by the Clinic in the three (3) months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or use of the Platform will be subject to the exclusive jurisdiction of the courts at Aligarh, Uttar Pradesh, India.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. Material changes will be notified through the Platform. Continued use after such changes constitutes acceptance of the updated Terms.
